WASHINGTON, D.C. — The Alliance of U.S. Inventors and Startups for Jobs (USIJ) applauds the reintroduction of the PREVAIL Act and thanks Senators Chris Coons (D-DE), Thom Tillis (R-NC), Dick Durbin (D-IL), and Mazie Hirono (D-HI), along with Representatives Deborah Ross (D-NC) and Nathaniel Moran (R-TX), for their leadership on this critical, bipartisan legislation. Their commitment to strengthening the U.S. patent system reflects a clear understanding of the challenges facing American inventors and the importance of reliable intellectual property protections to our innovation-driven economy.
The PREVAIL Act addresses long-standing concerns about abuse of post-grant proceedings at the Patent Trial and Appeal Board (PTAB), which have disproportionately harmed startups, small businesses, and individual inventors. By aligning PTAB procedures with those of federal courts, imposing a standing requirement, requiring clear and convincing evidence to invalidate a patent, and curbing duplicative and serial challenges, the bill restores much-needed fairness, predictability, and efficiency to the patent system. These reforms will help ensure that patent rights are not merely theoretical, but practically enforceable — encouraging investment in breakthrough technologies and protecting America’s innovation leadership.
