On February 25. 2025, USIJ filed an amicus brief in support of Netlist, Inc. in its appeal before the United States Court of Appeals for the Federal Circuit. USIJ asserts that the Patent Trial and Appeal Board (PTAB) has enabled “predatory infringement” by large corporations, undermining the rights of small inventors and startups. Without intervention, startups and inventors will continue to face an uneven playing field where their groundbreaking innovations can be systematically stolen and invalidated.
“The decision of the PTAB in this case, unless reversed by this Court, will take its place as a ‘high-water mark’ for the glaring injustice wrought by the creation of the PTAB and its administration by the USPTO.”
