USIJ Files Comments Supporting USPTO’s Proposed PTAB Reforms

USIJ has submitted formal comments to the USPTO strongly supporting its proposed rule changes to rebalance Inter Partes Review procedures and restore fairness, efficiency, and predictability in patent disputes. The NPRM reflects a long-overdue course correction: curbing serial and parallel challenges, requiring one-forum finality, and increasing transparency around real parties in interest.

For startups and inventors, these reforms matter. Multiple IPR attacks can destroy even the strongest patents — eroding the reliability of U.S. patents as a foundation for investment, commercialization, and disruptive innovation. USIJ commends Director Squires for advancing rules that align the PTAB with Congress’s original intent: a true alternative to district court litigation, not a duplicative tool used by large incumbents to increase cost and risk for small innovators.
