USIJ strongly supports the Trump Administration’s proposed reforms to the USPTO Patent Trial and Appeal Board, which finally confront years of “efficient infringement” that allowed Big Tech and foreign competitors—especially PRC-backed firms—to weaponize PTAB against American startups. The NPRM restores balance by preventing duplicative challenges, stopping re-litigation of patents already upheld in court, and requiring petitioners to choose a single forum for validity disputes. These reforms will protect “little tech” innovators, strengthen U.S. national security, and allow the USPTO to focus on high-quality examination and reducing the historic patent backlog. Together, they represent a long-overdue course correction that reestablishes the U.S. patent system as the global gold standard.
