USIJ Urges FTC to Address Patent Regulations That Undermine Startups

On May 27, 2025, the Alliance of U.S. Startups and Inventors for Jobs (USIJ) submitted a formal response to the Federal Trade Commission’s Request for Information (RFI) implementing President Trump’s April 9 Executive Order on “Reducing Anti-competitive Regulatory Barriers.” The filing highlights how PTAB procedures disproportionately harm startups and inventors, and calls on enforcement agencies to protect early-stage innovation, limit serial patent challenges, and support the bipartisan PREVAIL Act.

“Since its creation in 2011, the PTAB has destroyed the value of thousands upon thousands of patents covering inventions that were developed – often at considerable cost in human resources and capital – in reliance on the belief that the U.S. patents protecting these inventions were reliable and enforceable.
